Terms of Service

Effective July 19, 2026

These Terms of Service (“Terms”) govern your access to and use of NFTD, a free browser tower-defense game operated by Alien Planet Games (“Alien Planet Games,” “we,” “us,” or “our”), based in Vancouver, British Columbia, Canada. By accessing or playing NFTD, you agree to these Terms.

Acceptance

By creating an account, signing in with Discord, or otherwise using NFTD, you agree to be bound by these Terms and by our Privacy Policy and Refund Policy. If you do not agree, do not use NFTD.

Eligibility

You must be at least 13 years old to use NFTD. Purchases may only be made by someone who has reached the age of majority in their jurisdiction (19 in British Columbia) or by a minor with the express consent and authorization of a parent or legal guardian. If you are a parent or guardian who permits a minor to use your payment method, you authorize all resulting purchases and are responsible for them. By making a purchase you represent that you have the legal capacity and authority to do so.

Accounts

NFTD accounts are created and authenticated through Discord OAuth. You are responsible for maintaining the security of your Discord account and for all activity that occurs under your NFTD account. Notify us at support@nftd.gg if you suspect unauthorized access.

Virtual Items & Charges

Charges and any other in-game virtual items have no cash value and are not redeemable for money. They are licensed to you for use within NFTD, not sold or owned by you, and are non-transferable — except to the extent that NFT-linked tower unlocks are tied to a wallet you control (see “NFTs” below). We may modify, rebalance, or discontinue virtual items or features at any time.

Purchases

Charge packs and other paid items are processed by our payment processor, Stripe. Prices are listed in USD. Once payment is confirmed, charges are granted to your account automatically. See our Refund Policy for details on refunds.

Before you pay, the store displays the pack name, number of charges, total price, and currency (USD). Charge packs are digital goods delivered to your account immediately upon successful payment. Because delivery is immediate, and to the extent you consent to immediate delivery at checkout, packs are non-refundable except as required by law (see Refund Policy). The supplier of record is Alien Planet Games, Vancouver, BC, Canada. If a purchased item is not delivered to your account, contact us and you may cancel that transaction and receive a refund as provided by applicable law.

Acceptable Use

You agree not to cheat, exploit bugs, use automation or bots, manipulate the leaderboard, or attempt to buy, sell, or trade accounts, charges, or in-game items outside of NFTD’s own systems. We may suspend or terminate accounts that violate this policy.

NFTs

Holding certain supported NFTs in a linked wallet unlocks cosmetic towers and other content within NFTD. We do not sell, mint, or custody NFTs. When you link a wallet, we perform a read-only scan of its holdings (via Alchemy) to check for supported NFTs — we never request or require access to move, sign for, or spend assets in your wallet.

Supported NFTs are used only for cosmetic unlocks. We make no representation about the value, investment potential, or future utility of any NFT, and nothing in NFTD is financial, investment, or trading advice.

Disclaimers

NFTD is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the game will be uninterrupted, error-free, or available at all times.

Nothing in these Terms excludes, restricts, or modifies any right, warranty, guarantee, or remedy that cannot be excluded under applicable law, including the British Columbia Business Practices and Consumer Protection Act. Where such rights apply, our liability is limited to the maximum extent that law permits.

Limitation of Liability

To the maximum extent permitted by law, Alien Planet Games will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or goodwill, arising from your use of NFTD. Our total liability for any claim relating to NFTD will not exceed the amount you paid us in the 12 months before the claim arose.

Some jurisdictions, including British Columbia, do not allow the exclusion or limitation of certain damages or of liability for gross negligence, fraud, or personal injury; in those cases the above limitations apply only to the extent permitted by law, and nothing here limits your mandatory statutory rights.

Changes to Terms

We may update these Terms from time to time. If we make material changes, we will update the “Effective” date above. Continued use of NFTD after changes take effect constitutes acceptance of the revised Terms. For material changes we will provide reasonable notice (for example, an in-game or email notice) before they take effect.

Governing Law

These Terms are governed by the laws of British Columbia, Canada, without regard to conflict-of-law principles. Any disputes arising from these Terms or NFTD will be subject to the exclusive jurisdiction of the courts of British Columbia. If you are a consumer, this governing-law and venue clause does not deprive you of the protection of mandatory consumer-protection laws of your place of residence.

Termination and Suspension

We may suspend or terminate your access to NFTD, with or without notice, for violation of these Terms or to comply with law. You may stop using NFTD and delete your account at any time. On termination, your licence to charges and virtual items ends and, except as required by law or our Refund Policy, unspent charges are not refunded. Sections that by their nature survive termination (including Virtual Items, Disclaimers, Limitation of Liability, and Governing Law) continue to apply.

Intellectual Property

All NFTD content, code, art, and trademarks are owned by Alien Planet Games or its licensors. If you believe content on NFTD infringes your intellectual property, contact support@nftd.gg with details of the work and the allegedly infringing material.

Public Content

Your Discord username and avatar may be displayed publicly on leaderboards and match results. You are responsible for your Discord display name; we may hide or reset names that are offensive or infringing.

General

• Severability — if any provision is found unenforceable, the rest remain in effect.
• Entire Agreement — these Terms, the Privacy Policy, and the Refund Policy are the entire agreement between you and Alien Planet Games regarding NFTD.
• Assignment — you may not assign these Terms; we may assign them to an affiliate or successor.
• Waiver — our failure to enforce a provision is not a waiver.
• Force Majeure — we are not liable for failures or delays caused by events beyond our reasonable control.
